Alex Manning is the Senior Government Relations Director in the firm’s Government Relations practice following more than a decade of Capitol Hill experience. Alex advises clients on issues surrounding cybersecurity, privacy, data breaches, tax, trade policy, and immigration.

Previous Work

Prior to joining Arent Fox, Alex was the staff director of the Cybersecurity, Infrastructure Protection and Security Technologies Subcommittee of the House Homeland Security Committee. He also served as legislative director and chief foreign policy and homeland security advisor for Rep. Michael McCaul (R-TX) and as professional staff on the National Security Subcommittee of the House Government Reform Committee.

Alex also represented a multinational technology and consulting corporation on federal policy issues, including cybersecurity, tax, patent reform, immigration, and trade issues.

Back to the Future: House Moves to Update Email Privacy Law

In a key win for digital privacy advocates, the House unanimously passed the Email Privacy Act yesterday in a 419-0 vote. Supporters, including top Silicon Valley names and privacy groups, now look to the Senate and then President Obama to bring the popular Act to fruition.
 
The bipartisan bill from Reps. Kevin Yoder (R-KS) and Jared Polis (D-CO) would require law enforcement to obtain a warrant to search through emails and other messages that are more than 180 days old. The current legislation governing digital communications, the Electronic Communications Privacy Act, allows police to search through digital archives with just a subpoena or court order. Why 180 days? The technical ability to store information online was much more limited when the current legislation was originally passed. When were these rules drafted? 1986.

White House Announces Cyber Initiatives

This week, as part of a strategic effort to build momentum toward next week’s State of the Union address to Congress, President Barack Obama announced legislative proposals and executive actions to improve cybersecurity. The Obama Administration’s broad array of policy proposals could have a significant impact on how companies and other entities across all sectors of the economy collect and monetize customer data, share threat information, and notify consumers in the event of a data breach. If a company or similar entity stores customer data, the breadth of the proposed initiatives means that they are highly likely to affect such an organization.
